Cancellation policy; Return fees in case of cancellation

(1) For distance contracts the customer has a cancellation right according to § 355.

(2) The cancellation right does not exist for distance contracts for the delivery of goods that are manufactured according to customer specifications or clearly tailored to personal needs or which are due to their condition not suitable for return or spoil quickly or whose expiration date would pass.

(3) If the customer is entitled to a cancellation the customer must bear the regular costs of return shipment if the purchase price of the article to be returned does not exceed an amount of 40 euros or if, in the case of a higher purchase price, the customer has not yet undertaken to pay the purchase price or an agreed installment at the time of withdrawal. In all other cases the seller bears the costs of return shipment.

You may return merchandise that you have received within 14 days without indicating any reasons by sending the merchandise back. The withdrawal period begins at the receipt of this information in writing (eg. in the form of a letter, fax, e-mail) but not before receipt of the merchandise. Only in the case of goods that are not suitable for dispatch by parcel (e.g. in the case of bulky goods), may the return of goods also be declared in writing by requesting a return in text form. To comply with the notice period, timely dispatch of the merchandise or of the return demand is sufficient. Return shipments or return demands are to be directed at:

Return procedures
In case of an effective return the mutually received services have to be refunded and related benefits shall be returned. In case of deterioration of the merchandise and of related benefits that can not be returned or only returned partially you are obliged to compensate accordingly. Compensation is only due if the deterioration of the merchandise is attributable to a usage of the merchandise which exceeds examining its properties and functionality. “Examining the properties and functionality” is understood as testing the merchandise in a way similar to how it would be possible and common within a store. Repayment obligations must be fulfilled within 30 days. For the customer the period begins with the return dispatch of the merchandise or of the return demand, for the seller with the receipt of either.
